No Witness Policy

Middlesex Notary Co follows a strict No Witness Policy for all notary appointments. Clients are responsible for providing any required witnesses. This policy applies to all mobile notary, in person notary, hospital notary, senior facility notary, and document signing appointments.

Massachusetts notary law requires witnesses to be present at the time of the signing and to meet all legal requirements. To protect the validity of your document and ensure full compliance with state law, Middlesex Notary Co does not supply witnesses, does not arrange witnesses, and does not act as a witness.

Witnesses must be adults, must be able to understand the document being signed, and must sign willingly. Witnesses should know the signer personally and must be physically present for the full signing process. Witnesses may be asked to show identification if the notary needs to confirm eligibility.

The notarial act cannot be completed until all required witnesses are present. If witnesses are missing, unavailable, or unprepared at the appointment time, the notarization will not proceed. A new appointment may be required, and additional travel fees may apply.

This policy protects both the signer and the integrity of the document. It ensures compliance with Massachusetts notary laws and prevents disputes regarding the authenticity of witness signatures.

Clients are strongly encouraged to confirm the number of required witnesses before scheduling the appointment. This includes documents such as wills, powers of attorney, health care proxies, estate documents, real estate forms, and any other paperwork that legally or contractually requires one or more witnesses.
